GPNA Tip of the Week: Gifting Real Estate

Associate attorney G. Nolan Thomas summarizes the latest South Dakota Supreme Court case Field v. Field on the topic of gifting. A person making a gift, the “donor”, will have their intent judged by a South Dakota Court at the time the gift is made. Additionally, if you plan to gift the real property at a discount under a contract for deed, be careful about how you classify the ownership interest of the person receiving the real property, the “donee.” A gift of real property to a husband and wife as joint tenants with rights of survivorship will be considered convincing evidence of the real property’s status as marital property.

Small Business and Small Nonprofit Business Grants - Limited Time Period to Apply

South Dakota is providing grants of up to $100,000 to certain qualifying small businesses and small nonprofit businesses. The time period to apply begins October 13, 2020 and closes on October 23, 2020.

Updated Surveillance Protection Law

Legal intern Samantha Merrill reviews the updated surveillance protection law and its exceptions. As technology advances, so might the law. When it comes to the use of drones, this statement is particularly true. This past legislative session, South Dakota updated its surveillance protection laws, which went into effect last month on July 1 and is now codified as SDCL § 22-21-1.
